The lawsuit faults Cornell for failing to properly discipline the men after the alleged assaults, “all the while sheltering them from speaking to law enforcement, and silencing victims.”
Doe alleges that she arrived at the Chi Phi house already heavily intoxicated to visit a friend. After two members pressured her to consume what they said was ketamine, she alleges that they sexually assaulted her.
At approximately 1:42 a.m. on October 20, 2024, a message in the fraternity’s Snapchat group advertised her sexual availability. Doe alleges that additional men entered the room and that the assaults continued until approximately 5:45 a.m.
CBS News New York obtained video of the group conversation. A later exchange, for which the reporting does not provide an exact time, read:

The complaint dates Doe’s report to Cornell University Police to approximately November 8, 2024. CBS separately reports that campus police interviewed her on November 14 and 15, 2024. Ithaca City Police told CBS that the incident was never reported to its department.
Cornell says it conducted a Title IX investigation over several months, followed by hearings at which Doe and the accused students could testify and present evidence. According to the complaint, the Title IX investigation began on or about January 14, 2025, and at least twelve hearings took place between May 2 and May 29, 2025.
At a September 29, 2026, meeting with student government, Cornell President Michael I. Kotlikoff specified the outcomes: two students were expelled, two were suspended for at least two semesters, one had already graduated before punishment could be imposed, and two were found not responsible for sexual misconduct. The fraternity chapter was closed in 2024 and, as of September 30, 2026, remains barred from campus.
Cornell disputes any suggestion that writing essays was the sole consequence imposed on students.
Giuffra attributes Doe’s initially reassuring messages, reportedly exchanged approximately two days after the alleged assaults, to trauma and denial, saying she was trying to understand what had happened. Speaking to CBS before the September 28 announcement reopening the criminal investigation, he emphasized the absence of arrests:
